By accessing or using PersX ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by PersX ("we", "our", or "us").
Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.
User Accounts
You may create an account to save your growth profile and access personalized features. You are responsible for:
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate and up-to-date information
Notifying us of any unauthorized use of your account
Growth Assessment and Profile Data
Your growth profile is generated using AI analysis of your assessment responses. By taking the assessment, you understand and agree that:
Profiles are research-inspired, not clinical assessments. They are for growth strategy and self-discovery, not psychological diagnosis or medical advice.
AI-generated content may not be perfectly accurate and should be treated as a starting point for reflection.
Assessment responses and profile data are stored to provide your profile and improve the Service. See our Privacy Policy for details.
Anonymous assessment sessions are tracked via cookies. Profiles can be linked to an account if you choose to sign up.
Data Ownership and Portability
You own your profile data. At any time, you may:
Export your growth profile data
Request deletion of your data and account
Withdraw consent for data processing
By using the Service, you grant us a limited license to use your anonymized, aggregated assessment data to improve the platform and conduct research. This does not include sharing your individual data publicly without your consent.
Acceptable Use
You agree not to:
Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service
Scrape, crawl, or use automated means to access the Service without permission
Impersonate another person or misrepresent your affiliation
Upload malicious code, spam, or harmful content
Intellectual Property
The Service, including its design, code, content, and branding, is owned by PersX and protected by intellectual property laws. The assessment questions, scoring methodology, and blindspot detection system are proprietary. You may share your public profile link but may not reproduce the underlying system.
Subscriptions and Billing
Some features may require a paid subscription. If you subscribe:
Billing is handled through Stripe, our third-party payment processor
Subscriptions auto-renew unless cancelled before the renewal date
You may cancel at any time through your account settings
Refunds are handled on a case-by-case basis
During the free beta period, all features are available at no charge. We will provide advance notice before introducing paid tiers.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or secure.
The growth profile is not professional advice. It is not a substitute for professional psychological, career, or medical guidance. The profile is inspired by growth research but is not a validated clinical instrument.
Limitation of Liability
To the maximum extent permitted by law, PersX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive will continue to apply.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
